They have released other games during that time and were paid >$30million for the Max Payne license. Money hasn't been a problem for them.

Okay, we have 4 level designers, 53 modellers, 6 skinners, 7 web masters, and 14 producers. We're all done and the game is almost ready- we just need a coder to pull this stuff together

Re:They were using a very heavily modified Unreal 2 engine last I heard.
Re:it's not vaporware at all, they have just made some really bad decisions in the project, they have changed engines a number of times – 3 I believe, and I'm pretty sure they are actually using their own engine now?
I do think we'll see this game at the end of the year, and as long as they keep the same 'attitude' the first one had, I'm guessing it will do well.
